N.Y. judge says he may allow Empire State Building REIT plan

(Reuters) - A New York judge said on Monday he was leaning toward allowing a group that wants to roll the Empire State Building into a real estate investment trust to force any holdouts to surrender their holdings for a fraction of their value.

New York Supreme Court Justice O. Peter Sherwood said he would issue his written decision regarding Malkin Holdings' plan for the landmark building by the end of Tuesday at the latest.

Under the plan, the Empire State Building - owned by Empire State Building Associates LLC, an entity controlled by Malkin - would join at least 18 other properties in the REIT called Empire State Realty Trust Inc and launch an initial public stock offering.

The plan requires support from 80 percent of each of the three groups of investors who as early as 1961 put money in the entity that became the limited liability company. For four decades after its completion in 1931, the building ranked as the world's tallest building.

Last month Malkin filed regulatory documents that said it had garnered about 95 percent of the investor votes it needs to cross the 80 percent threshold.

Once Malkin reaches that threshold, it claims the right to force any remaining investors to sell back their stakes for $100 each unless they drop their opposition. The units, now held by 2,824 investors, could be worth more than $320,000 apiece if the REIT becomes publicly traded.

The decision under consideration by Justice Sherwood involves that provision. Opponents of the REIT plan contend that Malkin lost the right to force holdouts to sell their holdings in 2001, when he converted Empire State Building Associates into a limited liability company from a partnership.

A REIT is a property or mortgage company that is exempt from corporate income taxes if it distributes at least 90 percent of its taxable income to shareholders in the form of dividends.

Where they missed:? Thomas, an undersized safety whose best attribute is his ability to deliver big hits, suffered multiple concussions last season.? It?s too much of a risk to take with a fourth-round draft pick.? Ditto for Jones; if the Steelers are looking for a backup, they could have waited until a later round than four.? The decision not to take a tight end could be a problem, if Heath Miller suffers a setback while recovering from a torn ACL.

Impact rookies:? Jones and Bell likely will instantly be added to the starting lineup.? Barring injury, each could become a candidate for rookie of the year on their respective sides of the ball.

Long-term prospects:? A solid draft class with a couple of guys who could become contributors and leaders in the near future.? And if the Steelers are still as good at scouting receivers as they were when finding Wallace, Sanders, and Brown, Thomas and Justin Brown could become difference makers, too.

For the first time, researchers at Karolinska Institutet in Sweden have managed to obtain detailed images of the way in which the transport protein GLUT transports sugars into cells. Since tumours are highly dependent on the transportation of nutrients in order to be able to grow rapidly, the researchers are hoping that the study published in the scientific magazine Nature Structural & Molecular Biology will form the basis for new strategies to fight cancer cells.

In order to be able to fuel their rapid growth, cancer tumours depend on transporter proteins to work at high speed to introduce sugars and other nutrients that are required for the cell's metabolism. One possible treatment strategy would therefore be to block some of the transporters in the cell membrane which operate as fuel pumps, thus starving out and killing the cancer cells.

One important group of membrane transporters is the GLUT family, which introduces glucose and other sugars into the cell. Glucose is one of the most important energy sources for cancer cells and GLUT transporters have been shown to play a key role in tumour growth in many different types of cancer. In the current study, researchers from Karolinska Institutet have performed a detailed study of the way in which suger transport is executed by the protein XylE, from the Escherichia coli bacterium, whose function and structure is very similar to GLUT transporters in humans. For the first time, the researchers have described the way in which the protein's structure changes between two different conformations when it binds and transports a sugar molecule.

"In showing details of the molecular structure of the region that bind the sugar, our study opens up the opportunities to more efficiently develop new substances that may inhibit GLUT transporters", says Pr Nordlund at the Department of Medical Biochemistry and Biophysics, one of the researchers behind the study. "Information on the structure of the transport protein facilitates the development of better drugs in a shorter time. Such GLUT inhibitors could potentially be used to treat cancer in the future."

The study may be of significance not just to cancer research but also in the field of diabetes. GLUT plays a key role in diabetes since insulin works by activating the uptake of glucose from the blood by means of GLUT transporters in the cell membrane.

GLUT and the studied XylE transporter belong to the very large group of metabolite transporters called the Major Facilitator Superfamily (MFS), which is important in many diseases and for the uptake of medicines in cells.

"Many aspects concerning molecular mechanisms for the function of GLUT transporters are probably common to many members of the MFS family, which are involved in a broad spectrum of diseases in addition to cancer and diabetes," says Pr Nordlund.

As well as membrane transporters, which have undergone in-depth analysis in the current study, many different membrane proteins pass through the surface membrane of the cells. Their significance to the cell function and the development of drugs has been noted before, not least through the Nobel Prizes that were awarded to researchers who used mechanistic and structural studies to map the function of two other major membrane protein families, G-protein-coupled receptors and ion channels.

Pyongyang glitters but most of NKorea still dark

PYONGYANG, North Korea (AP) ? The heart of this city, once famous for its Dickensian darkness, now pulsates with neon.

Glossy new construction downtown has altered the Pyongyang skyline. Inside supermarkets where shopgirls wear faux French designer labels, people with money can buy Italian wine, Swiss chocolates, kiwifruit imported from New Zealand and fresh-baked croissants. They can get facials, lie in tanning booths, play a round of mini golf or sip cappuccinos.

Nearly 2 million people are using cell phones. Computer shops can't keep up with demand for North Korea's locally distributed tablet computer, popularly known here as "iPads." A shiny new cancer institute features a $900,000 X-ray machine imported from Europe.

Pyongyang has long been a city apart from the rest of North Korea, the showcase capital dubbed a "socialist fairyland" by state media.

But a year after new leader Kim Jong Un promised publicly to bring an end to the "era of belt-tightening" and economic hardship in North Korea, the gap between the haves and have-nots so far has only grown with Pyongyang's transformation.

Beyond the paved main streets of the capital, life remains grindingly tough. Food is rationed, electricity is a precious commodity and people get around by walking, cycling or hopping into the backs of trucks. Most homes lack running water or plumbing. Health care is free, but aid workers say medicine is in short supply.

For decades, North Korea seemed a country trapped in time. Rickety streetcars shuddered past concrete-block apartment buildings with broken window panes, chipping pastel paint and crumbling front steps.

But since 2010, as part of the campaign to build a new city for their new leader, Pyongyang has been under construction. Scaffolding covers the fronts of scores of buildings across the city. Red banners painted with slogan "At a breath" ? implying breakneck work at a breathless pace ? flutter from the skeletons of skyscrapers built by soldiers.

Often, the soldiers are scrawny conscripts in thin canvas sneakers piling bricks onto stretchers or hauling them by hand. In 2011, they set up temporary work camps along the Taedong River, makeshift shantytowns decorated by red flags.

Their work focused on downtown Changjon Street, where ramshackle cottages were torn down to make way for department stores, restaurants and high-rise apartments.

Today, the street would not look out of place in Seoul or Shanghai. Indeed, many of the goods ? Hershey's Kisses, Coca-Cola and Doritos ? on sale at the new supermarket were imported from China and Singapore.

"What is a 'delicatessen'?" a North Korean asked as a butcher in a white chef's hat sliced tuna for takeaway sashimi beneath a deli sign written in English. Upstairs, baristas were serving Italian espressos, bakers were churning out baguettes and white wedding cakes.

One new Changjon Street resident, Mun Kang Sun, gave The Associated Press a tour of the apartment she and her husband were granted in recognition for her work at the Kim Jong Suk Textile Factory.

A framed wedding portrait hangs on the wall above their Western-style bed. There's a washing machine in the bathroom, an IBM computer in the study and a 42-inch widescreen TV. AP was not allowed to visit other apartments to compare whether the furnishings are typical for Pyongyang residents.

Orphaned as a child, Mun said she began working in factories at age 16. She earned the title "hero of the republic" after exceeding her work quota by 200 percent for 13 years. She says she accomplished that by dashing around the factory floor operating four or five machines at once.

"When we heard the news that we'd get a nest where we can rest, and we got the key for our apartment and took a look around, we were totally shocked because the house is so nice," said her husband, Kim Hyok. "It's still hard to believe this is my home; it still feels like we're living in a hotel."

Though the apartment has faucets, old habits die hard. The bathtub was still filled with water, a bucket bobbing in the tub, as in countless homes across the country where water is pumped from a well, carried in by hand and used sparingly.

Elsewhere in the city, aging buildings are getting upgraded. But most are still drafty, the walls poorly insulated, even in the capital. Elevators and heat are rare. North Koreans are accustomed to wearing winter jackets and thermal underwear indoors from October to April.

Power cuts have been less frequent in Pyongyang since the opening of a hydroelectric power station to the northwest, but it's still common for the lights to go out in the middle of dinner. Most people just carry on drinking and eating.

Outside Pyongyang, nightfall comes early. In Ryonggang, west of the capital, lights were out as soon as the sun set. At one inn, two women stood chatting quietly in a lobby lit with a candle as a shrill voice from a radio broadcast chortled from loudspeakers nearby.

Kim Jong Jin's farm cottage in Hamhung has a generator, allowing him and his wife to watch DVDs at night on a TV they carefully cover during the day with a frilly lace veil.

Their thimble of a home is simple but spotless, the papered floors clean enough to eat from. Water is piped into a well in the kitchen. Heat comes from the traditional Korean "ondol" system of feeding an underground furnace with wood. Waste is turned into methane gas for cooking. Food for the household comes from the garden outside.

But not everyone lives in such relative comfort as the Kims, whose home government officials are willing to show off. There are stark signs of poverty across the country. A mother huddles over a child as she sits shivering by the side of the road. Barefoot boys in a village destroyed by floods scamper about dressed in little more than underwear. Sharp shoulders and splotchy faces betray the gnawing hunger of young soldiers.

Beyond the paved, pocked highways that radiate from Pyongyang, there are few roads between the denuded mountains, just dirt paths that become dangerously muddy with rainfall and treacherously slippery in winter. Villagers struggle to clear snow with makeshift shovels crafted out of planks of wood.

Private cars are a rarity outside the capital, and gasoline is scarce. In Hamhung, North Korea's second-largest city, soldiers cram into the backs of trucks powered by wood-burning stoves that send smoke billowing behind them.

Goods are strapped to the back of bicycles, from firewood to dead pigs. Old men sit crouched by the side of the road with bike pumps, offering to fix flats. Oxen, and people, plod past pulling carts.

The closest most may get to the capital in their lifetime is by seeing it on state TV. For them, Pyongyang would truly seem like a fairyland.

Life in the North Korean countryside would be familiar to South Koreans old enough to recall the poverty in their nation just after the Korean War. Indeed, into the 1970s, North Korea was the richer of the two Koreas.

Today, newly affluent South Korea has the world's 15th-largest economy. In North Korea, meanwhile, two-thirds of people struggle to find their daily meal, according to the World Food Program.

North Koreans acknowledge the devastating economic loss of the Soviet safety net in the early 1990s. But they blame the county's growing international isolation on the U.S., its Korean War foe, which has led efforts to punish North Korea for developing its nuclear weapons program.

Pyongyang instead has turned to fledgling trade with companies in China, Singapore, Indonesia, Italy, Egypt and elsewhere. These joint ventures keep the shelves in the capital stocked with goods, computer labs filled with PCs, streets crowded with VWs, in spite of sanctions.

For years, foreign goods and customs were regarded with practiced suspicion, even as they were secretly coveted. Kim Jong Un has addressed that curiosity by encouraging trade and by quoting his father in saying North Korea is "looking out onto the world" ? a country that must become familiar with international customs even if it continues to prefer its own.

Kim has not made it significantly easier for North Koreans to travel, channel surf or read travelogues posted online, but he is arranging to bring the Eiffel Tower and Big Ben to them in the form of a miniature world park slated to open later this year.

The flow of cash and goods has created a burgeoning middle class in the capital. Pyongyang now has a parade of fashionistas in eye-popping belted jackets, sparkly barrettes clipped to their hair, fingernails painted with a clear gloss. At one European-style restaurant last week, a young couple on a date sipped cocktails topped off with Maraschino cherries and feasted on pizza, their cellphones laid on the table.

At one beauty salon, the rage is for short cuts made popular by singers from the all-girl military Moranbong band who have jazzed up North Korea's staid performance scene with their bobbed hair, little black dresses and electric guitars.

"There are so many young women asking to get their hair done like them," hairstylist Chae Cho Yong said.

While the differences between the showcase capital and the hardscrabble countryside are growing starker, one thing remains the same: the authoritarian rule and the intricate web of laws governing life in the Stalinist state.

Even as they laugh, North Koreans calibrate their words. Criticism of the state and leadership is not only taboo but dangerous; when asked for their opinion, most people parrot phrases they've heard in state media, still the safest way to answer questions in a country where state security remains tight and terrifying.

Very few have access to the Internet, cable TV, international phone lines. It's still illegal for them to interact without permission with foreigners, who are kept on a tight leash and discouraged from making impromptu visits to homes, shops, restaurants and offices.

Around Chae, the cavernous barber shop was empty, not a single customer in the brand new swivel seats.

An employee explained that most North Koreans are at weekly ideology study sessions on Saturdays, the only day of the week foreigners are allowed inside.

While Snapdragon 600 is already showing up on various flagship devices like the HTC One, PadFone Infinity, Galaxy S 4, Optimus G Pro and Xiaomi 2S, we're still looking forward to the big daddy of Qualcomm's lineup this year: the Snapdragon 800. At a media event in Beijing earlier today, Senior Product Manager Yufei Wang confirmed that his company's next flagship SoC will enter mass production in late May, but he refused to comment on which upcoming devices will feature it. And due to the current state of the silicon (even though vendors like ZTE are already sampling it), we weren't allowed to run any benchmark tests on the Snapdragon 800 development devices on display just yet, though we've been told to stay tuned in June.

What makes the 800 shine brighter than the 600 is its more powerful Krait 400 architecture, which can maintain a clock speed of up to 2.3GHz; but like before, the four cores are also clocked asynchronously for better power management. On top of that, the 800 comes with the new Adreno 330 graphics processor with 30fps 4K playback capability, while still featuring the improved Adreno 320's FlexRender technology that can dynamically switch between direct rendering and binning rendering for optimized performance and efficiency. We'll save the nitty-gritty for the proper launch of this 28nm chip later this year.

South Africa passes secrecy bill

JOHANNESBURG (AP) ? South Africa's parliament has passed a bill designed to protect state secrets despite the concerns of some activists who fear it could undermine the country's young democracy.

Lawmakers in Cape Town passed the bill by a 189-74 vote, with one abstention, on Thursday. The bill now goes to President Jacob Zuma to be signed into law.

The bill provides for prison terms for those who disseminate classified information as well as those convicted of espionage. The government describes the measure as a balance between openness and national security.

Opponents worry that the bill could make whistleblowers, activists and journalists more vulnerable to prosecution if they expose cases of official corruption.

The bill was revised after a public outcry over its provisions several years ago.

Fuel barges explode, causing large fire in Ala.

MOBILE, Ala. (AP) ? A large fire that began with explosions aboard two fuel barges in Mobile, Ala., was rocked by a seventh explosion early Thursday and fire officials said they planned to let the fire, which has injured three, burn overnight.

Firefighters from Mobile and U.S. Coast Guard officials responded after 8:30 p.m. CDT Wednesday to a pair of explosions involving the gas barges in an area of the Mobile River east of downtown, authorities said.

As they were responding, a third explosion occurred around 9:30 p.m., Mobile Fire and Rescue spokesman Steve Huffman wrote in an email to The Associated Press. Additional explosions followed over the next few hours.

The Coast Guard said early Thursday that a one-nautical-mile safety zone had been established around one barge, which it said was "at the dock for cleaning."

Authorities said three people were transported to University of South Alabama Medical Center after suffering burn-related injuries. Huffman identified them as workers with Oil Recovery Co. The three were in critical condition early Thursday, according to hospital nursing administrator Danny Whatley.

Across the river, the Carnival Triumph, the cruise ship that became disabled in the Gulf of Mexico last February before it was towed to Mobile's port, was evacuated, said Alan Waugh, who lives at the Fort Conde Inn in downtown Mobile, across the river from the scene of the explosions. Waugh saw the blasts and said throngs of Carnival employees and others were clustered on streets leading toward the river as authorities evacuated the shipyard.

"It literally sounded like bombs going off around. The sky just lit up in orange and red," he said, "We could smell something in the air, we didn't know if it was gas or smoke." Waugh said he could feel the heat from the explosion and when he came back inside, his partner noticed he had what appeared to be black soot on his face.

U.S. Coast Guard Petty Officer Carlos Vega said the initial blast took place in a ship channel near the George C. Wallace Tunnel ? which carries traffic from Interstate 10 under the Mobile River. The river runs south past Mobile and into Mobile Bay, which in turn flows into the Gulf of Mexico.

Video from WALA-TV (http://bit.ly/15NEYJl) showed flames engulfing a large section of the barge, and a video that a bystander sent to AL.com (http://bit.ly/13vWz4G) showed the fiery explosions and billowing smoke over the river.

The cause of the explosion was not immediately clear, Huffman and Vega said.

"Once (the fire) is out and safe, a full investigation will take place," Huffman wrote.

Mobile Fire Chief Steve Dean told AL.com he was confident the fire wouldn't spread to nearby industrial properties, including the shipyard where the Carnival cruise ship is docked.

Huffman said the ship is directly across the river from the incident ? about two football fields in length.

The barges are owned by Houston-based Kirby Inland Marine, company spokesman Greg Beuerman said. He said the barges were empty and being cleaned at the Oil Recovery Co. facility when the incident began. He said the barges had been carrying a liquid called natural gasoline ? which he said is neither liquefied natural gas or natural gas. He said the company has dispatched a team to work with investigators to determine what caused the fire.

The explosion comes two months after the 900-foot-long Carnival Triumph was towed to Mobile after becoming disabled on the Gulf during a cruise by an engine room fire, leaving thousands of passengers to endure cold food, unsanitary conditions and power outages for several days. The ship is still undergoing repairs there, with many workers living on board.

Carnival didn't immediately respond to an emailed request for comment late Wednesday.

Earlier this month, the cruise ship was dislodged from its mooring by a windstorm that also caused, in a separate incident, two shipyard workers to fall into Mobile Bay. While one worker was rescued, the other's body was pulled from the water more than a week later.

Partial Lunar Eclipse Occurs Thursday: Watch It Live Online

The April full moon will pass through Earth's shadow in a partial lunar eclipse on Thursday (April 25). While the lunar event won't be visible for U.S. stargazers, moon fans can still catch the sight live online in two free webcasts.

The?lunar eclipse on Thursday will mark the first eclipse of any kind in 2013, and by sheer cosmic coincidence it will occur during the April full moon, which is also known as the "Pink" Full Moon. It is the first, and likely the best, of three lunar eclipses occurring this year.

You can watch the partial lunar eclipse live on SPACE.com here courtesy of webcasts provided by the U.S-based Slooh Space Camera and Italy's Virtual Telescope Project. NOTE: Both events depend on good weather at the observing sites. "It will be a great event!" Gianluca Masi, an astrophysicist with the Bellatrix Astronomical Observatory who runs the Virtual Telescope Project in Ceccano, Italy, told SPACE.com.

The first of the two webcasts will be provided by the Slooh Space Camera and begins at 3 p.m. EDT (1900 GMT). Slooh's broadcast team will be joined by solar scientist Lucie Green of the Mullard Space Science Laboratory in the United Kingdom, and feature views from the company's observatory on the Canary Islands, off the west coast of Africa. The webcast can also be accessed directly at the Slooh website: http://www.slooh.com

The Virtual Telescope Project webcast in Italy will begin shortly after the Slooh event at 3:30 p.m. EDT (1930 GMT). It will be carried live on SPACE.com as well, and can be accessed directly here: http://www.virtualtelescope.eu/webtv/

Lunar eclipses occur when the moon, Earth and sun align, with the moon positioned on the opposite side of the Earth from the sun.

Thursday's lunar eclipse may be the best lunar eclipse of 2013, but will not be as impressive as stunning total lunar eclipse, in which the entire moon is obscured by Earth's shadow. During total lunar eclipses, the moon can take on a blood-red hue due to light refracted by the Earth's atmosphere.

"This will not be a spectacular event, as the moon will enter only marginally the Earth?s shadow, but it will be well worth a look," Virtual Telescope officials said in a statement.

The other two lunar eclipses this year will occur on May 25 and Oct. 18. Both of those events are so-called "penumbral" lunar eclipses because the moon will only pass through the outer edge, or penumbra, of Earth's shadow.

In addition to following Thursday's lunar eclipse in online webcasts, Slooh has launched a new iPad app to make celestial events more accessible. The Slooh iPad App is available via iTunes, officials said.

"The free Slooh iPad app is a great way for individuals to experience Slooh's broadcasts and understand how the night sky works," Slooh President Patrick Paolucci said in a statement.

In addition to the lunar eclipses of 2013, there are also two solar eclipses to for stargazers to look forward to.

Next month, on May 25, the moon pass between the Earth and sun to create an annular, or "ring of fire" solar eclipse. That event will be visible from parts of Western Australia, eastern Papua New Guinea and several other island locations in the southern Pacific Ocean.

A rare hybrid solar eclipse, in which an annular eclipse transitions into a total solar eclipse depending on where a viewer is observing from, will occur on Nov. 3 and be primarily visible along a thin corridor that begins in the northern Atlantic Ocean and crosses to equatorial Africa, according to eclipse expert Fred Espenak at NASA's Goddard Space Flight Center in Greenbelt, Md.

Supertough, strong nanofibers developed

Apr. 24, 2013 ? University of Nebraska-Lincoln materials engineers have developed a structural nanofiber that is both strong and tough, a discovery that could transform everything from airplanes and bridges to body armor and bicycles. Their findings are featured on the cover of this week's April issue of the American Chemical Society's journal, ACS Nano.

"Whatever is made of composites can benefit from our nanofibers," said the team's leader, Yuris Dzenis, McBroom Professor of Mechanical and Materials Engineering and a member of UNL's Nebraska Center for Materials and Nanoscience.

"Our discovery adds a new material class to the very select current family of materials with demonstrated simultaneously high strength and toughness."

In structural materials, conventional wisdom holds that strength comes at the expense of toughness. Strength refers to a material's ability to carry a load. A material's toughness is the amount of energy needed to break it; so the more a material dents, or deforms in some way, the less likely it is to break. A ceramic plate, for example, can carry dinner to the table, but shatters if dropped, because it lacks toughness. A rubber ball, on the other hand, is easily squished out of shape, but doesn't break because it's tough, not strong. Typically, strength and toughness are mutually exclusive.

Dzenis and colleagues developed an exceptionally thin polyacrilonitrile nanofiber, a type of synthetic polymer related to acrylic, using a technique called electrospinning. The process involves applying high voltage to a polymer solution until a small jet of liquid ejects, resulting in a continuous length of nanofiber.

They discovered that by making the nanofiber thinner than had been done before, it became not only stronger, as was expected, but also tougher.

Dzenis suggested that toughness comes from the nanofibers' low crystallinity. In other words, it has many areas that are structurally unorganized. These amorphous regions allow the molecular chains to slip around more, giving them the ability to absorb more energy.

Most advanced fibers have fewer amorphous regions, so they break relatively easily. In an airplane, which uses many composite materials, an abrupt break could cause a catastrophic crash. To compensate, engineers use more material, which makes airplanes, and other products, heavier.

"If structural materials were tougher, one could make products more lightweight and still be very safe," Dzenis said.

Body armor, such as bulletproof vests, also requires a material that's both strong and tough. "To stop the bullet, you need the material to be able to absorb energy before failure, and that's what our nanofibers will do," he said.

Dzenis' co-authors are mechanical and materials engineering colleagues Dimitry Papkov, Yan Zou, Mohammad Nahid Andalib and Alexander Goponenko in UNL's Department of Mechanical and Materials Engineering, and Stephen Z.D. Cheng of the University of Akron, Ohio.

The 40-year-old actress tops the magazine's annual list of the "World's Most Beautiful," announced Wednesday.

Commenting on her selection, Paltrow says: "Around the house, I'm in jeans and a T-shirt. I don't really wear makeup."

She credits her workout routine for keeping her looking young and feeling strong.

Paltrow is married to Coldplay rocker Chris Martin. They have two children, Apple, 8, and Moses, 7.

Gay marriage: A matter of conscience | Opinion | Jewish Journal

In the sphere of human rights there comes a time when people of conscience are morally required to stand up and declare what they believe is right based on principles of justice and fairness, not for themselves but for others. While this may be especially true for politicians, opinion leaders, parents, religious figures and the like, it doesn?t end there; it is the moral duty of every citizen in a free society, and arguably the duty of every human being in any society, to take a stance on issues of conscience. Being a bystander may be convenient and comfortable, but it doesn?t meet the test. For me, as a prominent publicly identified Republican, the time is now and the issue is same-sex marriage. As the controversy continues to swirl around us and people have begun to take sides, I feel it is time to state my own opinion; that is to declare my support for the right of same-sex couples to marry.?

This, of course, doesn?t take any particular courage on my part. For me personally the stakes are low, but for others the consequences are high. Selfishly, when the history of the consequences of our time is written, I want to be recorded by my friends and family as having been on the right side, on the side of those who seek equal rights for all. In my view, the outcome of this debate is inevitable, but for now the question is how long it will take to get there and at what cost to the American fabric.

There were times before when I wanted to step into this fray, but the point seemed moot. The matter went to the Court; polls began to shift in favor of same sex-marriage; and 131 Republicans activists stepped forward to lend their support in an amicus brief to the court. No less a conservative voice than Ted Olsen has defended the rights of same-sex couples to marry, as have Meg Whitman, David Frum, Ken Mehlman, Rep. Ileana Ros-Lehtinen, Rep. Richard Hanna, Sen. Rob Portman and Sen. Mark Kirk. Unfortunately, last Friday the Republican National Committee unanimously passed a resolution reiterating its opposition to same-sex marriage. Therefore, I can no longer be silent on the issue.

The arguments to allow same-sex marriage to proceed and be recognized are many. Even if the Supreme Court finds no constitutional right, Federalism, which Republicans hold dear, would at least allow states to decide the issue for themselves (Proposition 8 aside, it can only be a matter of time before Californians make this choice). From a pure political standpoint, Republicans are playing a losing hand, with public attitudes shifting, especially among young voters (Gallop found that 73 percent of voters aged 18-29 favor legalization). Philosophically, the party that supports individual freedom, commitment and less government intrusion ought to get out of the way of people wanting to express their individual liberties. In another example, the ?death tax? that Republicans oppose also falls unfairly on unmarried same-sex couples; for married couples the government doesn?t collect their levy until the second partner dies. Not true for same-sex couples who may own a business or a house together and be forced to sell to pay the taxman when their partner dies.

It is easy to be taken in by some for the arguments against same-sex marriage. Since switching my own thinking on the subject and discussing it with friends ? notably both Democrats and Republicans ? I hear them all the time: ?You can?t redefine a word?; ?This will undermine ?traditional? marriage?; ?I am in favor of civil unions, but not marriage?; and on and on. This is all nonsense; it sounds logical, but is not.

The concept of traditional marriage is a nice fairy tale: Boy meets (virginal) girl; they fall in love; their nuclear families walk them down the aisle; they have children and live together faithfully until death. So this is marriage. Except that it doesn?t always happen that way anymore. People cohabitate before marriage; they get divorced, they remarry (for some this cycle repeats itself over and over ? all are called marriage). If a 90-year-old near-senile man marries a 20ish gold-digger, that?s a legally recognized marriage. If two strangers meet at a Las Vegas casino one night and run off half-drunk to the local chapel to get married ? that?s a legally recognized marriage. If a high school teacher who goes to jail for having sex with an underage boy marries that boy when she is through serving her term and he has reached adulthood ? that?s a legally recognized marriage. If a woman falls in love with a serial killer awaiting execution on death row, corresponds with him and they decide to marry ? that?s a legally recognized marriage. But if two men who are committed to each other and live together for 50 years wish to be married, somewhere along the way we can?t call this marriage??

Fundamentally, we as Americans believe that we are all entitled to be free and to pursue our own dreams and happiness (while we think this is some uniquely American idea, consider that same-sex marriage is already legal in Argentina, Belgium, Canada, Denmark, Iceland, Netherlands, Norway, Portugal, South Africa, Spain and Sweden as well as in some parts of other countries). I do not see how allowing same-sex couples to have the same right that I have to get married will in any way diminish my own freedom or my own happiness. How? Which right will I lose? (Rights, fortunately, are not a zero-sum game.) Why is something that is allowed for me denied to someone else? Where is the concept of fairness in all this?

I am hoping that other Republicans will step forward along with me and tell our party leadership that they are making a mistake. Now is the time to get on the record, one way or the other. Abstaining from an important moral issue is not a choice.

On Thursday at LaFayette High School, Northwest Whitfield?s baseball team had what coach Todd Middleton termed a ?lapse? on the way to their first sub-region loss of the season.

The Bruins, who were already guaranteed of playing Cass next week for the Region 7-4A championship, were back to business as usual Saturday when the Ramblers visited Richard S. Chumley Field.

Northwest pitcher Cameron Alday gave up just four hits, and the Bruins celebrated senior day by pushing across runs in each inning except the fifth on their way to a 9-1 victory against LaFayette (9-14, 6-9) in their Sub-region 7B-4A and regular season finale.

The Bruins (19-4, 14-1) host Sub-region 7A-4A champion Cass in a best-of-three series for the region title and the No. 1 seed in the Class 4A state playoffs. They?ll play a doubleheader at 5:30 p.m. Wednesday in Tunnel Hill, with the potential rubber game scheduled for Thursday at the same time and location.

Both teams are guaranteed of hosting in the first round of the state playoffs, but the winner would also have that privilege in at least the second round.

?We?ve tried to play every game like it is a championship game this season, so it won?t be any different against Cass,? said Bruins senior center fielder Brandon Smith.

Smith went 3-for-3 with a pair of RBIs on Saturday.

?We?ve played ball together forever it seems, and we know each others? strengths and weaknesses,? he said. ?We play well off of each other and know what we need to do.?

Northwest took advantage of plenty of opportunities on Saturday, scoring runs in a variety of ways, and the first four came off just two hits.

Smith got things started in the first with a screamer to third that LaFayette?s Brice Cleverly thought he had picked, but the umpire ruled the play a trap. Smith went to second on a grounder to first, stole third, then scored on a Diego Peralta groundout to short.

A pair of walks and an error in the second inning brought in two more North-west runs, and Kyle Brock?s single in the third drove in A.J. Orozco, who had walked earlier in the inning.

The Bruins loaded the bases in the fourth and chased pitcher Josh Manning without hitting the ball out of the infield after Alday drew a walk, Smith had an infield hit to the left side and Brady Middleton laid a bunt down the third-base line. Peralta drove in a run on a fielder?s choice, and Middleton came in to score after a pickoff play at second went off the shortstop?s glove and into the outfield. Peralta later scored on a wild pitch.

On the mound, Alday cruised, facing just three over the minimum through four innings. LaFayette scored its lone run in the fifth when Clayton Lane led off with a double, moved to third on an infield hit and scored on a sacrifice fly to center. Northwest ended the scoring in the sixth as Smith scored on an RBI single from Middleton, who came home thanks to Aaron Ball?s two-out single.

?We had a lapse on Thursday at their place, but I think we got it back on track today,? coach Middleton said. ?We executed and came back with consistency today. Our guys are a pretty even-keeled bunch, and we haven?t done anything different throughout the year. The biggest thing now is staying focused.?

? Dalton 6, Heritage-Catoosa 1: The Catamounts (11-12, 10-5 Sub-region 7B-4A) avenged two losses from earlier this week by pouncing on the visiting Generals early ? they scored three runs in the first and never trailed ? to close the regular season with a win.

Matt Wells went 2-for-2 with an RBI, Kaleb Hill had a hit and drove in a pair of runs and Michael O?Brien added a hit and an RBI.

Wells pitched five innings for the Cats, allowing one earned run on four hits. He struck out four and walked three. Dale pitched 1 2/3 innings, striking out four, while Will Erwin recorded the final out via strikeout on senior day at Dalton.

?That was big,? Cats coach Shane Ramsey said. ?It?s big momentum for us. We got beat in nine innings (Thursday) night and should?ve won that game. We?re just glad we have a chance to get into state.?

Heritage locked up the sub-region?s No. 2 seed on Thursday, while Dalton owns the third seed. The Cats will play at Sub-region 7B?s No. 2 seed next week ? the Gen-erals host 7B?s No. 3 seed ? in a best-of-three series to determine Region 7-4A?s third and fourth Class 4A state playoff seeds. A doubleheader on Wednesday would be followed by a third game, if necessary, on Thursday.

Ramsey said Dalton will face either River Ridge or Cedartown.

? Lakeview-Fort Ogle-thorpe 1, North Murray 0: The Mountaineers blinked in the Region 5-3A extra-innings battle in Chatsworth, with the Warriors scoring in the 10th without the benefit of a hit.

In the final inning, an LFO batter was hit by a pitch to reach base with one out. The next batter drew a walk, and a passed ball pushed both the runners to second and third, setting up what proved to be the game-winning sacrifice fly. North Murray (9-12, 6-6) put a runner on with one out in the bottom of the inning but failed to advance him.

North Murray wasted a strong effort by starting pitcher Aaron Granger, who allowed four hits and a walk while striking out nine in seven innings. Ethan Lents worked the rest of the way, allowing a run on two walks, a hit batter and a hit.

Jared Campbell went 2-for-4 as the only Mountaineer to reach base more than once. North Murray tallied eight hits but scattered them and had trouble moving baserunners around.

?We played solid defense,? North Murray coach Steve Granger said. ?It?s just that our approaches at the plate weren?t our best approaches of the year, let?s just put it that way. We would put runners on and would swing at the first pitch. We wouldn?t work the count at all. We were just a little bit overly aggressive. Sometimes you win that battle and sometimes you don?t. Today we didn?t.?

Coach Granger did say the Mountaineers remain in good shape to finish in the top four of the region standings and earn a berth in the Class 3A state playoffs.
